The agreement
These Terms of Use are an agreement between you and Null Machine (“Budz”, “we”, “us”) for the Budz iPhone app and this website. By using Budz you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use Budz.
What Budz is, and what it isn’t
Budz is a budgeting and planning tool. It helps you plan your paycheck, track spending, remember bills and save toward goals using the information you enter.
- It isn’t a bank. Budz doesn’t hold, move or transfer money, and it doesn’t connect to your bank or card accounts.
- It isn’t advice. Nothing in Budz, including safe-to-spend, goal paces and Ask Budz answers, is financial, investment, tax or legal advice.
- Its numbers are estimates. They’re only as accurate as what you enter. You’re responsible for your own financial decisions.
Who can use Budz
You must be at least 13 years old, or the minimum age required in your country, to use Budz. If you’re under the age of majority where you live, you need a parent or guardian’s permission, and they’re responsible for any purchases.
Your account
- You can sign in with your email address using a one-time code, or start as a guest.
- A guest account is tied to the device you use it on. If you sign out or remove the app before adding an email, you may lose access to that budget.
- Keep your email account and your iPhone secure. You’re responsible for activity in your Budz account. Tell us at contact@nullmachine.in if you think someone else has access to it.
Budz Plus subscriptions
Budz is free to download. Some features need a Budz Plus subscription, which you buy through the App Store.
- Plans: yearly at $39.99 with a 7-day free trial, or monthly at $4.99. Prices are in US dollars; the App Store shows the price for your country before you confirm.
- Free trial: if you start the trial, you won’t be charged until it ends. We’ll remind you before then. Cancel at least 24 hours before the trial ends and you won’t be charged.
- Payment: payment is charged to your Apple ID account when you confirm the purchase, or when your free trial ends.
- Auto-renewal: your subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the current period ends.
- Managing and cancelling: open Settings → your name → Subscriptions → Budz on your iPhone. Cancelling stops the next renewal; you keep Budz Plus until the end of the period you’ve paid for.
- Refunds: purchases are handled by Apple, so refund requests go through Apple under its policies.
- Price changes: if the price of Budz Plus changes, you’ll be told in advance as Apple requires, and you can cancel before the new price applies.
Your content
You own the information you put into Budz. You give us permission to store, sync, back up and display it, and to show it to people you share a budget with, only so we can run Budz for you. This permission ends when you delete it or your account, except for copies we must keep by law. Our Privacy Policy explains how we handle it.
Acceptable use
Please don’t:
- Use Budz for anything illegal or to harm anyone.
- Try to access other people’s accounts or budgets without their permission.
- Send unwanted invitations or use Budz to spam anyone.
- Disrupt, overload or attack the app or our servers, or get around our security.
- Copy, modify or reverse engineer the app, except where the law allows it.
- Use bots or scrapers to access Budz.
Our app and brand
Budz, including its software, design, logo and illustrations, belongs to us and our licensors. We give you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices that you own or control, as allowed by the Usage Rules in the App Store Terms of Service. Members of a Family Sharing group may also use it where Apple allows.
App Store terms
Because Budz is distributed through Apple’s App Store, these terms also apply:
- These terms are between you and us, not Apple. We, not Apple, are responsible for Budz and its content.
- Apple has no obligation to provide maintenance or support for Budz.
- If Budz fails to meet any warranty that applies to it, you may tell Apple, and Apple will refund the purchase price, if any. To the fullest extent the law allows, Apple has no other warranty obligation for Budz.
- We, not Apple, are responsible for addressing any claims about Budz, including product liability claims, claims that it doesn’t meet a legal or regulatory requirement, and claims under consumer protection or privacy law.
- If someone claims that Budz infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
- You confirm that you aren’t located in a country subject to a US government embargo or designated as a “terrorist supporting” country, and that you aren’t on any US government list of prohibited or restricted parties.
- You must follow any third-party terms that apply when you use Budz, such as your mobile data plan.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Changes to Budz
We’re always improving Budz, so features may change, be added or be removed. Beta versions may be unfinished. If we stop offering Budz Plus, we’ll tell you in advance.
Ending these terms
You can stop using Budz at any time and ask us to delete your account. We may suspend or end your access if you seriously or repeatedly break these terms, or if the law requires it. Cancelling a subscription is done through Apple, as described above.
Disclaimers
Budz is provided “as is” and “as available”. To the fullest extent the law allows, we don’t promise that Budz will be uninterrupted or error-free, or that its estimates will be accurate, and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the fullest extent the law allows, we won’t be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, savings or data, arising from your use of Budz. Our total liability for any claim about Budz is limited to the greater of the amount you paid us for Budz in the 12 months before the claim, or US $50.
Some places don’t allow these limits, so they may not apply to you. Nothing in these terms limits rights you have under consumer protection law.
Governing law
These terms are governed by the laws of India, without regard to conflict-of-law rules. If you live in a country whose consumer protection law gives you the right to bring claims in your local courts, you keep that right.
Changes to these terms
If we change these terms, we’ll update the date at the top. If the change is significant, we’ll let you know in the app before it takes effect. If you keep using Budz after that, the new terms apply.
